HANDYMANBRAND TERMS OF SERVICE (USE)

HandymenNework is owned and operated by Handymanbrand.com This agreement ("service agreement", or "agreement") is between Handymanbrand ("we" "our" “network” “service” “handymanbrand.com”) and any person or entity ("you") who logs on, views or uses this website ("site"). We provide a service allowing access to a data base network of “Service Provides” to you, subject to the following Terms of Service, (or "TOS") which may be updated by us from time to time without notice. We provide this service on an "as-is" basis without warranty, either expressed or implied. Your use of our site in any way constitutes your acceptance of this agreement.

It is understood and agreed to that Handymanbrand is an online Directory of “Service Providers” only. Subject to this Agreement, handymanbrand.com grants you a right to access its online directory of Service Providers (Listings) via http://www.handymanbrand.com or such other uniform resource locator (URL) as handymanbrand is known as, and may designate from time to time (also know as HandymenNetwork.com, Findalocalhandyman.com, HandymenUSA.com and others)

We do not guarantee or warrant the performance of any Service Provider or the quality of the services performed under any agreement between you and any Service Providers. If you enter into an agreement with any Service Provider, your rights will be governed by the terms of that agreement and by applicable federal, state, provincial, and local law.

You agree to indemnify handymanbrand.com from any and all claims, damages, losses, or expenses (including all attorney's fees) incurred directly or indirectly from the use of this site. Any new features that augment or enhance the current Service shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that handymanbrand assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. Under no circumstances will handymanbrand.com be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via our directory. We have the right to view and reject or delete anything posted to any part of the site which we deem inappropriate. To terminate postings. To modify or terminate the site at any time without advance notice. We have the right to revise this agreement from time to time and without prior notice - you may view the current service agreement at any time with the service agreement. You are solely responsible for checking for any changes to this agreement. Handymen Network reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that handymanbrand shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. The failure of handymanbrand to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. If you are a California resident, you waive California Civil Code Section 1542

We reserve the right to alter the site as we see fit. To promote the site as we see fit. To enhance the site as we see fit. To send site-related e-mail communications, including notifications when you receive messages from other members, newsletters, and administrative messages. You may also create a hyperlink to the home page of handymanbrand sites so long as the link does not portray handymanbrand, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive matter.

You agree that handymanbrand.com in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or anypart thereof), immediately and without notice, and remove and discard any content within the Service, for any reason, including, without limitation if handymanbrand believes that you have acted inconsistently with the letter or spirit of the TOU and our code of ethics. Further, you agree that handymanbrand shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination.
